RESTORE YOUR FIREARM RIGHTS

Firearm rights restoration attorney for Virginia Beach, Chesapeake and Norfolk

Rebuilding your life after a felony conviction does not automatically remove every firearm restriction. Attorney Brook M. Thibault and The Coastal Virginia Law Firm help Hampton Roads residents review the Virginia restoration process and the separate federal-law questions.

Can I restore my gun rights in Virginia?
Virginia Code § 18.2-308.2(C) provides a circuit-court petition procedure for people covered by that statute. A person with a felony conviction must have civil rights restored by the Governor or other appropriate authority before qualifying to petition. Restoration of civil rights and restoration of firearm rights are separate steps.

What must a petition show?
The court may grant relief in its discretion for good cause shown. A strong presentation addresses the complete history and relevant evidence of rehabilitation. Depending on the circumstances, useful records may include proof of civil-rights restoration, conviction orders, completion of supervision, employment history and support letters. The result is not guaranteed.

Which Hampton Roads court handles the petition?
For a Virginia resident, the statute directs the petition to the circuit court where the person resides. That can mean Virginia Beach, Chesapeake or Norfolk depending on the applicant’s residence. The statute provides a separate rule for nonresidents. We confirm the correct court before preparing the petition.

The Commonwealth’s Attorney receives notice and may respond. Either party can request a hearing. We help identify supporting records and prepare for the questions the court may consider.

What about federal restrictions?
A Virginia restoration order must be evaluated alongside federal law and the laws of any other relevant state. Protective orders, certain domestic-violence convictions, federal convictions and other circumstances can require additional analysis. Do not purchase, possess or transport a firearm based only on a website, a background-check assumption or restoration of voting rights.

Does sealing a record restore gun rights?
Sealing, expungement and firearm rights restoration are different forms of relief. A sealed record is not, by itself, proof that all firearm prohibitions have ended. We review the reason for the restriction and the complete legal history.
